I have a terminal disease and I am in the process of a divorce from my wife.
She wants me to put in the divorce papers that she gets half of my life insurance when I pass away. Do I have to let her have it. Is it even negotiable? Can I change benificiaries after the divorce is final?

Hi Rice, you might have already received the idea from the other posters that you're not required to keep your soon to be ex on the life policies if the child support issue isn't there.

Firey, the judge can actually rule that the insured is required to maintain his ex-spouse as beneficiary if she has minor children and is receiving child support. The judge can also include this in the divorce decree. This is often done in order to safeguard the interests of the kids. However, if this isn't the situation with the OP, he is free to exclude the ex from his policies.

Hey Rice, you haven't mentioned the state you're from. The state laws will play significant role in determining the future of your policies. In some states, such as Texas, the beneficiary status of the suppose will automatically get void after the divorce and he/she will no longer be entitled to receive the benefits if its not specifically mentioned otherwise in the divorce decree.

YEA...what happened to spouses' 'dedication' to the OTHER spouse? I guess this 'gal' hasn't heard of that, yet. Thsi reminds me of a true story..............remember the accident with the Moviestar, Christopher Reeves? His wife stood by him 'through thick and thin.' NOT even telling him she had cancer herself. Gosh...........THAT was a dedicated marriage.

You have the right to do whatever you want to do. Whatever you decide, make sure that its whats best for everyone and that its the right thing. Don't make decisions out of anger.

Typically. you can name whoever you want as a beneficiary, even your dog.

You can also sell your policy for a percentage of the death benefit and receive cash right now that you can use for whatever you want, but if you do this she might be entitle to a portion of that cash, so be careful.

wow, just when you think you have heard it all, how the hell do some people look at themselves in the mirror, human nature just blows my mind sometimes, greed, greed, greed. Stuff like this just makes me angry.

I am actually hoping that this guy does NOT have minor children with this woman, she sounds like a real gem. Man beware if this lioness is on the prowl, grrrrrrrrrrrrrrrrrrrrrrrrrrr!!!!!!!

Are we discussing about the life settlement plans over here?

Life settlement offers the opportunity to the seniors and at-times the terminally ill individuals, with no dependants to receive the death benefits after their deaths, to trade their life policies to get immediate cash-out on the plans. The buyer of the plan would then become the entitled recipient of the death benefits.

Its an option if you need immediate money for the treatment as well. IMO the OP can consider this since the wife is seeking divorce and this will rule out her rights over the life policy benefits.

I can see selling a policy if you are really in dire straights or needed it for medical reasons. I like your idea and thought on the matter Jeremy.
