Can ex-spouse receive death benefits?

Can my ex-spouse receive my life insurance benefits even when she is remarried?

I’ve a small life insurance through my employer where my ex-wife is the beneficiary. She has expressed her desire to continue with her beneficiary status even when she is married now to another man.

I’d like to know, if I’m required to keep her on the policy or need to change it by informing the employer? Am I committing fraud if I don’t change the beneficiary name?

well, first of all, you can name anyone as your beneficiary. if you wish that your ex-spouse be your beneficiary, then there is no need to change anything. otherwise, there is nothing wrong with changing the name if it is your wish. it is your policy, so whose name should be on the policy should be due to what you want, and not dependent on the wants of your ex-spouse.

That's just ignorant!! Why doesn't she get her OWN policy? Or....if she is remarried, why doesn't her CURRENT husband get a policy for them? Talk about 'Money Hungry' ( in my opinion). :roll:

you can choose any one beneficiarry for your policy.but it should be on utmost good faith.otherwise you are the king you can do any thing

If you are paying child support the court can order you to keep her as beneficiary as insurance the child suppout will continue should you pass away.

I do agree with Lori, its your deceision. If you want her to be your beneficiary, its absolutely fine, you can make any one benficiary

my ex just remarried,and she is the benifitiary.ther is a court order,but i am disabled and not expected to live very much longer,i want my kids to have the money,they are both 21 yrs old. please help me!

Who is the owner? Who is the insured? What does the court order say?

If you can change your Life Insurance to the kids, than I would do that. Did I miss something, or did the Courts tell you that you HAD to keep your EX as beneficiary?

I find it infuriating that the Ontario Courts order the non-custodial parent, ie the one supporting the ex-wife and their children, to keep the ex-wife on as beneficiary of his life insurance policy. Talk about ex-wives getting a free ride, over and over. Family law decisions sicken me. I myself am a divorced woman who would never take advantage of her ex-husband. I earn my own money and he earns his. I think it should be against the law for women to be ''kept'' by their ex-husbands. What a communist country we live in.

Please don't forget that the courts do not normally "make" the laws, they simply enforce them. If there is any blame to be placed, it is on the legislative body that writes/votes for/approves the law. Some of those people no longer have the ounce of sense they were born with.
