| Yes, my ex remarried about a year ago. My son is his only child. Not sure about probate, but I know that I have to get the court involved with a trust, and guardianship over my son's trust, right? I know alot about some things, but unfortunatley, life insurance is not one of them. So, once again, thank you guys. My ONLY concern is my son getting what is due to him, with all respects to the surviving spouse, of course. |

Hi Bjamm,
What is the volume of his estate? Are there unpaid taxes and debts of the deceased? Answers to these questions would determine whether or not you need to open probate.
Have you contacted a probate lawyer yet?

Life insurance wouldn't come under probate if it has a named beneficiary. Life insurance benefits are always paid to the beneficiary of the policy irrespective of the terms of the will. I guess that your son's name is not there as beneficiary, right?
