On a homeowners insurance claim. I have a contractor who when he came I already had an estimate for around 1800.00. When he scoped the job he found several items that were missed and met with a supervisor to walk the job to justify his difference and ended up with an estimate around 13,000.00 Since I have a leak coming in around a window which I have tried to find for years, I did not want to have some of the repairs done at this time until I was sure this issue had been resolve. The contractor had no problem crediting me for the work not done. The problem is I feel I should be entitled to the O&P that was charged for the work not done. Am I entitled to it?

Your post lacks some info... are you saying that the window leak was part of the loss and instead of having having the contractor handle that portion, you contacted and had someone come in? How was that repair cost paid for... was it still in the claim? Was the O&P not paid by the insurance company? If so, it seems like the contractor kept that portion of the O&P for himself. If he did keep the O&P for that portion of the work he did not handle than I'd say he's not entitled to it. Actually you should not be paid for it either as O&P is only paid when there are 3 or more trades involved. If there are less, you are not acting as a general contractor. But if the insurance already paid O&P on that portion than I'd say you have more of a right to it than the contractor. Of course, he may wan to give you a hard time about it.

I hired a general contractor. There was flooring, painting & drywall work. The O&P was included in the estimate. The contractor said that neither of us are entitled to the O&P for the work not done that it should be refunded to the insurance co.

In my opinion, protect our home from uncertainties by owning cheap house insurance. There are many companies which gives you cheap insurance against you vehicle, property, life. So take the benefits of insurance.
