Slipped and fell in the store front: who is liable?

I wasn't sure where it post this so I am putting it here. Yesterday I slip and fell on a puddle of water at a nationwide large chain store. I told the manager and filled out the report. I wanted to know what my options are because last night I was doing ok but this morning I feel like a truck ran over me. Can someone help me?

I haven't heard from the insurance guy since he took my statement and told me it would take him a couple of weeks to do the investigation. Should I call him? If I call him what do I say?

yes call him, and just ask how the investigation is coming and does he have an estimate regarding how much longer, and is there anything you can do to help speed this up.

I received a letter two days ago, that they didn't find that the store was negligent. The letter didn't explain how the water got in the floor. Do I have any recourse?

Sure...first ask them to explain who was negligent if not the store...how did the water make it to the floor...you could always get an attorney as well...did they offer you medpay for medical bills at least?

No, I don't think we have medpay in Texas. The letter said that I was responsible for my own medical payments.

Yeah, you may not have med pay on auto's, but I'd be reallllllllllllly surprised if a dwelling of any kind didn't have it...you might contact the dept of ins in texas, I'm betting all dwelling policy's have medpay I've NEVER seen one that didn't...there does not have to be ANY negligence on the insured's part or any liability assessed to the insured for a claimant to collect med pay. Worth a look.
