Small claims court: Does it resolve any claim?

I've come across discussions involving 'small claims court' many times over

here but neither do I have any idea of such court proceedings nor

do I know the nature of insurance complaints that are pursued over

there. Any guesses!

Hi Lori

Back after a long time :) Is there a limit for small claims court that varies by state? Can truelife take the other party to court for amounts the insurer isn't ready to pay? (if that is the case)

Hi Sil...yes all jurisdictions have their own limits, and regulations, the OP will have to check on those

When I talked to my carrier, they said if I choose to repair my vehicle using my UM part of policy, then I'd pay my deductible and then they would try to collect from the other driver to get my deductible back, but it sounded it it doesn't always work.

Did you get an estimate of how much it would cost you to repair your vehicle? Check out if the UM part of your policy + deductibles covers the cost of repair totally or i there something you have to shell out-of-pocket. If you have to bear some out-of-pocket costs you might want to take a look at what settlement the other party at fault is offering.

If the person I have a dispute with lives an hour and a half away, do I have to go all the way there to file or is there an easier way?

You may choose the county where the defendant resides in or the county wherein the dispute or event has been caused. The defendant has the right to ask it to be moved to a venue that suits him. If he does it, the judge would decide whether the trial should be moved or not.
