Last week my motorcycle fell over in my driveway, I was in the garage when it occurred. Apparently the kickstand was not fully extended?(A motorcycle forum has reported this happening frequently with this motorcycle).
After a conversation with my agent who advised that it was probably Comp and would not result in any increased rates. I filed the loss. The adjuster telephoned today and advised that the act of the motorcycle falling over was a collision and therefore would fall under such. Note I hold a policy for home,auto and motorcycle with this company.
When I asked her to define collision the adjuster laughed and basically told me it was what had happened to my motorcycle. 
She advised me if I proceed with the claim it will result in my rates being increased next renewal.
So does this sound correct, does it fall under Collision??

| Yes. Look at it this way... what would it be if you drive the motorcycle right into a guardrail? How about a wall? Both collision. Well, the motorcycle colliding with the ground is no different. If nothing else, it really falls under the collision definition of "upset" (to cause to turn or tip over). Also, there are 7 (?) named perils included under comprehensive coverage and what happen is not listed. |

Yep, it most certainly is collision...this is one of the things that happens when a well meaning agent trys to work anything with claims...  that isn't their field of expertise and frankly most of them have no idea about the actual coverages and definitions...The only way you could've got this covered under comp (darn it should've thought this thru...  just kidding) is if you had turned it in that a vandal came by and kicked it causing it to fall, THEN it would've been comp...another thing, more than likely if the kick stand was faulty and there was a mechanical failure with it, they should not cover the kick stand replacement but will cover all insuing damage...just like if a tire blows, due to it's condition, tire isn't covered, but the resulting damage is.

ok in this same subject, what if I say that it was really windy and maybe it was parked in a not so sturdy surface and the wind in combination with the surface condition caused it to tip, is that collision or comprehensive

I think the above responses hold good even in your case. The high wind caused the motorcycle to collide with the ground. It'd certainly get covered under the collision coverage of the policy.

sorry still collision....all you have to say to change it to comp is , ''someone (unknown vandal) kicked it over'' (vandalism)
