Med Pay In Oklahoma

HI all,

What a great forum! Glad I found you.

I'm very new to this type of communication, so treat me with 'kit' gloves!

Does anyone know off-hand if Oklahoma is a so called "double dip" Med Pay state?

My insurance company is telling me "yes", and that I have non-reimburseable med-pay... but we want to be sure.

Family (4 of us) were 'flipped' over at 75mph on the turnpike by a drunk driver. Glad to be here to be able to even ask this question! Lots of 'soft-tissue' pains, wife may have to have knee surgery, our 11yr old son, who had brain surgery in June, sustained a pretty good concussion (we'll have to monitor to make sure he doesn't have any bleeding on his brain)

Well after having another argument and telling my adjuster's boss that this was to much for me to handle and suggesting I was going to hire an attorney, I got a call today. They are transfering 24150.00 to my checking account and told me to contact them with anymore med bills. Is this some trick?

So know I'm thinking of Med Pay as a total different policy in conjuction with auto. So med pay is resposible for my med bills not at my BCBS rate becuse they dont pay my premiums. They have to pay the rate before BCBS kicked in. Also, all my MRI bills and Therapy bills up to 100,000$.
Then at settlement they have to pay all these bills again, and then subrogate with BCBS with the liabal party wich happens to be USAA. I just want to make sure I'm seeing this clear. Thanks for all your help..

Not going to happen. If your medical expenses are paid for by Med Pay, and med pay is not subject to subrogation in OK, there will not be a secondary claim for medical expenses under Bodily Injury liability. Pain and suffering (general damages, and other expenses not covered by Med Pay (special/specific damages), yes. If any of those other expenses were paid for by other insurance, those other amounts are probably subject to subrogation.
