I live in Oklahoma and I was in a car accident last year but not at fault. I have been using my health insurance and med pay for co-pays and deductibles. My health insurance has advised the insurance company at fault of their intent to subrogate. Can I settle with my health insurance out of my med pay (if there is any left) and get a release from them?

Welcome to the forum, Do you have a lawsuit pending over this accident? If so I don't think you can settle just one piece of it, I think it has to be all taken care at once.

We have a lot of knowledgeable folks here that will come on and advise you further, many of them work the insurance industry. I hope that you find the advise that you are looking for. goodluck

Not sure what type of med pay is available in OK but you mention should be automatic. That is, your MP should be addressing as much of you medical bills as it can. If it could cover all of the bills, it should. No release is involved as there is no right to release.

tscope, but what if there is a pending lawsuit, do you think this will have any bearing on paying the bills or do they pay the bills while they are trying to settle things out? I did not think you could just settle part of a lawsuit, thought it all had to happen at once, kind of a package deal, done and over with.

My husband needed future surgeries and the insurance company made that part of the settlement, it was up to him to put the money up and have the surgery done. They estimated the cost and paid him when the lawsuit was settled. Now this is in Pennsylvania. This even varies in counties in pa, if his accident would have happened in the next county over it would have been a million dollar lawsuit.

I know I am in PA and my Health insurance wants full payback of what they paid on my behalf. The atty says they will problay settle for less than the actual amount. I myself am wondring if my future medical will be taken into consideration. At least every month and a half to two months I have to go into the hospitol for shots and that automaticlly is $1200 plus all the co-pays for meds and doctor visits..it really adds up. I just keep thinking about the future and if we ever lost our medical coverage...I think Good natured your hubby had the right idea...get something paid ahead of time and put it up just in case.
