Property - slip and fall

Hi, someone has slipped and fallen upon my property. Do I have any responsibility being the property owner?

I fell at the grocery store 19 months ago and my attorney say the store is liable and negligent for my fall. The non-slip rug in front of their ice machine went flying and so did I. During discovery he found in the maintenance reports that prior to my accident the repair company told them to keep the dirt and debris out from under the ice machine because it could cause the machine to leak at the coils. AFTER my fall (1 1/2 hours after) the repair company repaired the machine and in their report it says that dirt and debris was clogging the coils causing the leak. Lot of water under and around the machine. There was not warning signs or cones out.
The manager told me while I was laying on the wet floor that the machine had just been worked on.

What is your guess........ negligent or not? My medical is now at $83,000. I have 3 bulging disks pressing in on sciatica nerve and permanent nerve damage to my hand.

We have done written interrogitories, had depositions, done supplimental interrogitories and have settlement mediation in 2 weeks. If we do not settle then we are on the trial doctet for January.

Anyone ever take their case to actual TRIAL? How did that work out?

I slipped on a piece of banana that was in the bread aisle. I had just turned into that aisle when I slipped on it and fell down on my tailbone. I was looking at the bread, not the floor. Why would they not take 100% liability since it happened while I was shopping in their store?

Why was the banana there?
Who put the banana there?
How long had the banana been there?
Did the store have notice that it was there or should they have known it was there.
The banana may have been dropped seconds prior to you walking over that area. The store can't follow every customer around making sure they don't drop anything. Now if you can prove that it had been their for (x) amount of time then you might have a case.

Also:
Did there happen to be a cartoon character in the vacinity. Might be worth checking into.

If you fall outside of someone's house becuase of ice or snow, it is NOT automatically the homeowners fault.
Ice, snow, rain, these are things that are natural. Chances are unlikely the homeowner can be sued.
If a gutter has a major leak and it shows that the leak made the sidewalk or outside stairs icy and dangerous, then the homeowner will likely lose.
Not easy to sue and win just because of snow or ice.

It is the responsibility of you, if the person claims a insurance it will be on yours because the property is users, you need a advice from a lawyer or your adviser to take this issue in account.

the adjuster told me recently that they paid BCBS and closed my case due to lack of liability. I did not receive any correspondence re their decision,etc. I had a foot contusion, and lost several days from work. Should I request written details about their decision?
