Truck parked front of house.
Had some pror damage on right side. Was struck from rear. Adjuster penialized me with prior damage. However recent accident caused more damage to same side. What are my options?

Were you specific, talking to the adjuster, about the 'prior' damage? (Just a suggestion here..) Do you happen to have pictures, of the truck, with the prior damage on it: some kind of proof? I'm NOT saying you're NOT telling the truth,..I'm just saying, if you DO have proof, this 'issue' would be more in your favor. Did the adjuster 'total' your vehicle because of the 'prior' damage?

Your option was to repair that prior damage. Do you think it fair to pay to repair the prior damage with this damage? Of course not, they owe you for the damage you sustained in THIS accident...is that what you were paid for?Posted: Sat Sep 26, 2009 12:42 pm Post Subject:
In the case of prior damage, you are only owed for the most recent lost. The exception is when the recent damage is in the area of the prior damage as you described. The only option is to repair both. For example, six months ago someone hit your car while it was parked on the passanger side of the rear bumper. The damage at that time was significant to render the bumper to be replaced. Then later on down the road, someone hits the drivers side and you file a claim. Upon inspection, the adjusters notes the prior damage whether that damage is/was repairable or needed a replacement and deducts that amount from the recent loss.
