my boyfriend was driving my car, and was in an accident. we went thru the insurance company, and he was at faut. Should he have to pay the deductable, or me since it was my car? He said he would, but we have broken up since then, and of course, my car is not fixed.

well, you are not very lucky one.Here is the 2 options either you pay for repair or he. If you want to pay for so you forget every thing such as friend or boyfriend or right or who wrong.. and second option is the court for your X-boyfriend
and they will made him pay for his wrong doing and his accountable for his doing..

It would've most certainly been a moral obligation, for him to pay your deductible. You ultimately are responsible. You could always take him to small claims court to get a judgement and make him pay it. I'd bet on a judge siding with you.

You've learned a good albeit tough lesson about picking boyfriend, and who you let drive your car.

In Texas, your boyfriend would be liable to pay for the damages to your vehicle. If he had liability insurance on another car at the time (and you weren't living together), there is a possibility his policy would pay for your vehicle to be fixed.

The reason I say "a possibility" is under the Texas Standard Auto Policy it would pay. However, not all companies in Texas use the Texas Standard Auto Policy. Many companies have received permission from the Department of Insurance to not cover this type of loss.

GOSH!! Sorry this had to happen to you, OP. Sometimes, depending on the Insurance Co, they have that 'one time accident forgiveness' thing going on. I don't know if this applies to you, though. If you DO take your ex-boyfriend to court, you would have to 'shell out' MORE money for the extra expense, etc. And, possible STILL end up paying the Deductible. I agree with LORI ( and the others..) here......he sure has a moral obligation to try and work something out with you.

Yes true trinigirl2b. He should be morally obliged to pay for the damages. However, I am afraid you will have to pay up first regardless of whether he pays you or not. Like Lori said you may take him to small claims court to get the money if he does not willingly and without much hassle pays up the money to compensate the damages.

AnMarie, are you saying that in Texas, ins doesn't stay with the car? Or to put it another way, if there's a policy on the car it is NOT primary?
