| My homeowner insurance is taking care of everything because auto insurance will depreciate my damages. So, in order to get my house put back together I had to use my insurance, which seems unfair to me. We will have to go to a motel while our house is being repaired. My whole house is a mess. My life has been disruppted. The guy was drunk, and was drivng his fathers car. |

Your carrier will go back to the at fault party for full reimbursement including your deductible once everything is done. Don't worry this driver isn't getting off the hook.

Well, if you have the resources to fix your house yourself, then hire your own team of attorney's to take on the driver of the car for reimbursement go for it. Otherwise it seems fair that your insurance company is willing to do all that for you and all you have to pay is your deductible.
Furthermore, the reason for this is that you are trying to get more than the other driver's insurance company owes you. They only owe for the actual loss, the actual value of your damaged property. That's why they depreciate. How old is your house? Had you just recently replaced all of the damaged parts with brand new? Then why would the other company owe you an upgrade? Your homeowner company, on the other hand, owes you for the full replacement cost because you have a contract with them that states they will not depreciate. Seem pretty fair to me.
BTW, does that fact that the guy was drunk and driving his father's car somehow make it even less fair? |
