How to file a BI settlement

I was involved with a no fault accident. The other person rear ended me. I had my car totalled. I went to doctor after a week or so, as the day of accident was friday and could not get doctor appointment. I just went to chiro. The final bills run to 3K or so. I still need to pursue treatment for 2 more months. Now, I wanted to know what can I include in the claims in order to get the claims settled? Can I include future claims, loss of wages, hardship? For loss of wages, I did not miss a day at work, but I had to adjust timings during the work to get the treatment. The chiro said that it's normal after the treatment, although I do experience some pain in neck and back, but it's mild now. Do I need to visit any specific doctor now?

No that's not it, the ONLY good claim to an adjuster or an insurance company is a CLOSED claim...so I can all but guarantee that's not it..

The only thing I can think of is like I said, 'low impact' injury...how much was the damage to your vehicle and what was repaired or replaced? and if they are only going from pictures, they need to get someone under the front of their insured's vehicle, a urethan cover can show little to no damage, but have damage to the aborber, and/or rebar, even a rail

They paid around 3K or so since it;s old car. Well, BI claim I submitted was around 3K , I submitted more but the adjuster says they do not consider future claims. Also I have some pain on one leg at hips due to direct impact. I havent even diagnosed, i thought it will go away on it;s own, but it often pains. I just went for neck and back treatment, as I wanted to keep things simple on injury claim.

Hi Lori,

They say that the damage to their insured vehicle was minimal, only license plate was damaged, so they are only offering me $ 500.

is this from pictures? Didn't your vehicle total? They cannot 'wholely' determine an injury from only their insured's vehicle damage.

thanks for the reply. as far as I know the claims adjuster only referred to pictures. my vehicle totalled, yes. What can i do to atleast get the medical bills that I paid recovered? I have no prior injury. But they say that the medical bills may not be related to their drivers fault

I know that your vehicle totaled..but what damage was done to your vehicle? The rear bumper, deck lid, tail lamps? What was damaged? There was an estimate written in order for them to total your car...see if you can find that.

Hi Lori,

I am not sure what damage but that includes rear bumber, some parts inside, truck. Trunck was not opening, until it was fixed. But I wanted to know whether they can come with specific information as to what would be the vehicle damage that they deem appropriate and what would be the Bodily Injury and make a final adjustment. Now, they are completely denying Bodily injury stating that the vehicle that hit mine is not damaged, it has only scratch on license plate. What is the remedy for me, I have already complained to DOI, before they offered me $ 500 for BI. Should I hire attorney?

I don't understand how the license plate is ALL that is damaged on their vehicle, and your's is totaled...

First off it they are looking ONLY at pictures...it might appear the licesen plate is all that is damaged...

If I were you I'd tell them that you'll give them one more opportunity to get there insured vehicle into a shop up on a lift, or their cover off, or send someone to look at it that knows what they are looking at, because this is impossible...unless your vehicle was damaged prior to this loss, this is physically impossible. what is possible is for a car with a urethan cover to hit you, and someone to take a picture, (and not a good one) and for it to look like that's all that's damaged..those covers can fold in two and pop right back out leaving a mess behind them to the rebar, perhaps even into the core support...this is just stupid..and/or yes an attorney is the only way you'll get anything it sounds like...You need to be absolutely SURE about the damages to your car were caused by this loss.

thanks again for your help. I asked them to share their vehicles pictures. They say that they wont share those pictures with me. Can you tell me how do I request them to justify rejection of the medical claims? They have the doctors narrative which clearly states that the injury was caused due to accident, they have run thru my medical history. Whether their car bears any damage or not, my injury certain caused by the accident is what I wanted to proove

Well it sounds like they already have...basing their entire decision (apparently) on the damage (or lack of) to their insured's vehicle.

You need to look at the estimate of damage they wrote on your vehicle. If you can attach it to a post, or just type what it says that would help a lot...I'm betting their vehicle has a lot more damage than they saying or are aware of...has their vehicle had the front bumper cover taken off? doubt it....how do they explain the amount of damage to your vehicle?
