Accident Release form question

What does this mean? Why is this included on the release form? Husband was not in vehicle..I was the one injured. Is this standard practice?
Is this because we have children?

To procure payment of the consideration referred to herein, we do declare and represent that we are presently married, and were married on the date of the incident recited herein, and that we have no qualifying disabilities and qualifying dependents which would enable a claim to be made by or on behalf of any unmarried dependent, as defined by section 768.0415, Florida Statues (2007)

Yes, it's standard. This is common in most states, because a spouse can have a "loss of consortium" claim as well..This protects them and releases their insured from the possibility of your husband presenting an additional claim on down the road.

When I handled BI claims, it always took up all the room on the draft, I'd have to write (as an example), pay to the order of, "Mrs. Jane Doe and Mr. John Doe, individually and as husband and wife" in payment of, "full and final release of all claims known and unknown" or for a singe person, "Jane Doe a single person" Very Happy funny isn't it all the legal garbage..

If we are no longer married? Do I need to still have him sign it if we were married when I had the accident?

Yep, if you were married when you had the wreck he'll have to sign the release, or the carrier more than likely won't pay you.
