Did you not have UM on your own policy? Was the uninsured motorist issued a citation? You could always get a judgment, then collect it under whatever guidelines your area allows. If the other party was issued a citation contact your countys prosecuting attorney and ask that restitution be part of their punishment. Also some areas have victim funds.

If the other driver is at fault, and this has been established, then I believe they are technically liable for your repair and medical costs as well as their own - whether they have insurance or not.

Of course if they don't have insurance it'll be tougher to get the miney out of them, but the liability still rests with them.

As Lori mentions, your policy may also cover you for Uninsured or Underinsured Motorists if you've elected to take that cover.

If not, you will need to begin legal proceedings to recover your costs directly from the other driver.

Are you looking for a law firm to guide you? Or is it that you're looking for some kinda loan? I need more information to be able to assist you in this regard.
