our home was damaged due to a heavy storm in march 2008. the assessors have been four times, and a fraud investigator has taken a 30 page report. no interim payments no assistance. where do we go from here.

Fraud investigation on a storm claim? There wouldn't be any payments at all until the investigation is completed.

What fraud did they think occured in a storm claim? When was the last time you heard from anyone and what did they say?

Investigations may lead through different phases till they'd come to a conclusion. If your home got damaged due to a storm, it would appear a natural claim if there are other such potential instances in your locality. But in case your carrier suspects a foul play they'd offer settlement only after a careful investigation. If the issue is not resolved you'd either need to file a complaint with your state DOI or file a lawsuit.

Wow, are the words "bad faith" in your vocabulary ? Nobody takes that long to do an investigation that I've ever heard of. Maybe you forgot a little more of the story ?

I had a client who turned in a burglary claim and then was shocked after they refused to pay him...after the company investigator noticed the burglar's pry marks from opening the window were on the "inside" of the window Wink

Not really. I just wrapped up a storm claim from May. The insured and his attorney kept arguing that myself and the structural engineer about what caused the collapse of a 125 year old building. Our conclusion was lack of maintaining the structure and wood rot, which a long time determine. It is not uncommon for some types of storm claims to drag on.

Could be the assorted "items" that had to be disposed of due to the storm damage and prior to the adjuster arriving, coupled with the lack of evidence that such items ever existed.

. . . And I just bought a new 52" big screen TV the day before from a guy in the parking lot at Best Buy who said the store wouldn't take it back because he lost one of the instruction books, so he offered to sell it to me for $100 less.

Fraud . . . naw!

Investigations under any claim is normally carried out when the claim settling agency feels that there is close proximity between the taking of the policy and occurence of event (which is not the case with you, as the loss occurred because of natural peil, which should have been reported widely), or, when they feel that the insured is using fradulent documents to exaggerate the claim amount.

In any case a period of 21 months is too long a period by any standards for a claim adjuster and investigator to reach to a conclusion.

If you can share more details with me about your claim (like items claimed by you and brief policy details), may be I can help you with my last 10 yrs exp. in the field.

I would agree, "except", (and I'm betting) that the SIU dept is involved, likely some statement under oath, also but they requested phone records etc...now if the insured is not getting the requested info the to carrier timely or at all..that will most definately HALT the claims progress. And I've seen this very thing many times in SIU claims
