hi, i was driving and had the right of way and a car from my passengers side was attempting to make a left turn, it was not at a stop sign and it was out of a a apartment complex. she didn't see that there were cars coming. so i hit her because she made teh turn without seeing me. she kept saying she was sorry, i was driving at the posted limit.. i also have a witness. is there anything that can cause someone to assume that I'm at fault and not her?

Sort of confusing the way you described it. Whoever was in the apartment complex is required to yeild to traffic.

All things being equal and the accident happening they way you said it did, then no. No insurance company should be able to find out at fault. That doesn't mean that some won't try. I wouldn't worry about it. Make the claim with their carrier and see where it goes.

Could be a ton of reason's... you could have been drunk at the time... you could have been tuning your radio and not seen her pull out... you could not have taken reasonable actions to avoid the accident.... the list goes on.
Probably the main consideration the other carrier will have is the point of impact to the other person's vehicle. If it's the rear end then there might be a question as to why you did not see, and avoid, a vehicle that had time enough to get almost across your lane of travel.
In all, I doubt they would put any blame against you.
