But two of the five will not send back their verification paperwork? Does nobody get anything then? The insurance company says they can't do anything or pay anyone their share until they have all the paperwork back so it just sits in a drawer waiting. Anyone know?

Good for you, Kim! for pursuing this through the OR Dept of Insurance.

If more people knew that their state insurance regulator can probably do more in one day than any lawyer can do in one year, they would be far better off.

Nice to know that OR requires a 30-day settlement, compared to California's general provision of 45 days.

Making a report to the CA Dept of Insurance, even though you know this claim will be resolved, will at least alert the regulators that there may be a problem with the insurer's claims dept.

This is usually just the tip of the iceberg of unfair claims practices. But without the consumer complaints, the regulators often don't realize there's a problem.

Good for you, withholding the funds was a crock, boo at them.

Here's a tip for later and for anyone who stumbles upon this discussion. Going to an agent at State Farm could have resolved this much quicker. The state farm office would have been highly motivated in making good on this case.

NO carrier wants to deal with their states DOI, NONE of them...especially if it's a justified complaint...they are all 'timed', (meaning the DOI's don't mess around when they ask a question you have 'x' amount of time to give them a good answer)...nor do any carriers take a DOI complaint lightly they are ALL logged...

Great job Kim...what was their excuse for their employee telling you EVERYONE had to turn in their forms before they would pay one cent?
