We sub-contract employers for roofing. One sub-contractor has an existing knee injury that he claims he exacerbated while working on a roof. He is trying to make a WC claim. Are we looking at a potential claim if he is not an actual employee and if he had a pre-existing condition?

What state is in question?

California and many other states have a "Subsequent (or Second) Injury Fund" to handle such claims before they go to a Workers' Comp carrier.
