auto insurance

My agent sold me liability insurance twice on my s500 mercedes and I owed $50k on it. The car in registered to my daughter and the credit union. The first time the policy lapse before I noticed it. The second time he did it again, I called him up and asked him to change it 10 times over a 3 week period. Subsequently my daughter had a wreck in it and now the claim department says they have no record of me calling to change the policy and the agent lied and said I asked for it after the accident. What can I do?

But I did ask him repeatedly over a 3 week period to change my policy. And when my policy went up the 2nd time I asked him to confirm that he changed it to full coverage, he never had time. He said customer service and they said call the agent. My policy kept going up. I kept calling but he would never make time. Then after the accident to he tried to have me to sign a false affidavit to lower my payments. At that point I sent him a letter to cancel it because he never changed it to full coverage nor would he address why my policy went up and my driving record was the same as it was before on the first policy.

Well, just like "Judge Judy" on TV, this is a matter of "He said-She said", and the best story-teller wins. As others have said elsewhere on this forum, there are usually three sides to every insurance story: His, Hers, and the truth, the latter being somewhere in the middle.

If you believe the agent was truly negligent, file a claim against his Errors & Omissions (E&O) policy and see what happens.
