How do I sue an Auto Insurance company

Here is my story my car was wrecked because some dufus decided to pass another car in the opposite lane and would have hit me head on if I wouldnt' have went into the ditch. NO ONE STOPPED. Imagine that. My car looked fine on the outside but had major damage underneath with the engine and transmission needing replaced because the accident broke the mounts. So Farmers Insurance put used parts in my car which I was not happy about but at the same they assured me if anything went wrong they would make it right. Needless to say 6 months later both the transmission and engine need a lot of work and now they are telling me that they don't warranty parts. Farmers are the ones that put JUNK parts in my car and now I have to pay to fix them because they chose JUNK parts???? After they told me they would make it right? Needless to say that's just a piece of it. It took them 4 months before I even got my car back the accident happened July 9th and I didn't get my car back til the middle of November. What can I do, I pay insurance for this reason and now they won't pay up.

Obviously they had noting to do with the repair time. They inspect the damage and issue the payment. They don't work on the vehicle.

Most states allow used parts and your policy probably does not exclude them from using them either.

I can't speak for exactly what was said when the parts were first put on. Yes, if the parts are not correct in some way Farmers will take care of it. I'm betting they said this and not that they would warranty to the parts forever. Used parts _do_ have a warranty from the supplier. Has someone told you what this warranty is?

Let me put these "junk" parts into perpective.... they are used parts pulled out of another vehicle. Where your engine and transmission brand new or where they used? So used parts were used to replace used parts. If you wanted new parts (something better then you had before) you can pay for the difference. But upgrading your vehicle to something much better then you had before is not part of the insurance contract. No one likes that... I don't like that... but that is how it works... has always worked.

I'd inquire about the warranty on the parts. Ask Farmers how long the supplier warranties them. You can also move your issue up the corporate ladder.

Lets start at the beginning..answer some questions and we'll see if we can help.

What state did this occur in? Why did it take four months to repair your vehicle? Year/make/model/mileage of your vehicle when the accident occured...Do you have the final repair bill? EXACTLY what parts were replaced? Did the shop and/or your carrier give you a warranty...tranny and motor mounts break all the time, that doesn't always (actually rarely) requires replacement of the motor/tranny. Most used or rebuilt trannys/motors have some sort of warranty..What EXACTLY is wrong with your vehicle now? I'm betting the tranny and motor were not replaced...

Please post EXACTLY what parts they replaced and EXACTLY what is wrong with your vehicle now.
