We are about to file bankruptcy, however, my son's car is in our name. He is 17. Should we transfer it to his name just in case we file chapter 13 so they cannot use it as an asset

I doubt anyone here knows the bankruptcy laws well enough to answer that question (this is an insurance forum). From what I hear they will go back so many months prior to the filing to see if the person transfered ownership of real property. So I doubt that will work.

(My '2 cents'). I don't think that will work, either. When my friend filed BK, her Lawyer/BK Courts went 'back' to see what property was in her name, had long it was in her name, etc.

Ask the attorney you're using to file your bankruptcy, he/she will know _________________ "Never, never be afraid to do what's right, especially if the well being of a person or animal is at stake.
