Auto death in Mississippi

If your brother was in a fatal car wreck and you paid the funeral cost. and you find out his auto insurance will cover the funeral cost. Can the insurance company write you out a check if you have proof or will the check go to the wife?

It is still going to be dependent on the language of the policy. If there is a "facility of payment" clause, it would allow a person who has paid any expenses (such as a funeral) on behalf of the insured to be reimbursed up to the policy limit.

Can't tell you if that provision is in the contract, it's up to the insurance company to include it. If you have access to the policy, you can look for the provision that would pay a benefit for a funeral and see who the benefit is payable to. Too many possibilities (well, three or four) to guess.

The check would go to the insured's estate. Most likely the person in charge of this will be the wife.

The wife would not pay for her husbands funeral and won't pay someone back who paid for the funeral? :roll:
