Facts
10/09 Head-on collision - other driver at fault
Both vehicles totaled
Recd payment for my vehicle - $24k
$23k in medical bills
My Injuries - broken right wrist, arm, bruised sternum, soft tissues injuries to neck and shoulder. Right handed
Personal Injury claim filed and I obtained an attorney
My info
46yr married diabetic no pre-existing conditions or fractures
5/10 my attorney submitted medical records and demand package
7/10 at fault insurance adjuster requested all medical records for last 5 years.
8/10 my attorney submitted signed release forms to at fault ins adjuster.
9/10 my attorney checked on status, at fault ins adjuster stating they were still missing some records 1 - from my OB/GYN and 1 - from my optometrist.
When I called the drs listed above I was told they never sent payment for the medical records so they just waiting for payment from the at fault ins adjuster.
Is this normal I can't help but get frustrated and feel they are trying to just drag this out. I have been patient and ran around getting medicals records from doctors that have nothing to do with the injuries I suffered from the car accident ie., eye doctor come on . What else should I expect from the at fault ins adjuster

Those "cats" can certainly do a lot of damage.

Once you sign off on a settlement, you have agreed to release all claims against the other party(ies).

You received a total of $10,500 out of a $25,000 lawsuit. That seems pretty substantial to me, after attorney's fees and medical expenses have been paid..

first offer was 2,000 for inconveinence 2nd was from the supervisor and she called hers damages for 3,000. Why are they calling them different things. We are not at fault for the accident and live in texas.

Have you asked the insurance company for the answer to your question?

Damages - inconvenience. It really makes no difference. Have you been inconvenienced by the accident? Of course. Have you suffered damages because of the accident? Of course.

Maybe they are offering you a total of $5000 . . . $2000 for your inconvenience, and $3000 for your damages.

Naw . . . you live in Texas . . . they wouldn't do that.

tryin to figure out persona injury claim i had to sue my own insurance company. the other driver had no insurance my policy limit 300,000 my medical bills were 27000. i had pip 0f 25000. im dealin with american family. i suffered a fractured pelvic

i live in wisconsin the driver has been invovled in three hit and run accidents besides mine .im in the process of settling my claim is in the legal dept.as of nowi i have an attorney but its been almost a year.

There is no "calculator" that the court uses. There are some general guidelines, perhaps, that inform the court that the amount of damages the jury wants to award is excessive.

You measure your specific (or "special") damages objectively in terms of medical expenses, lost time from work, other out-of-pocket expenses you would not have incurred. The so-called "pain and suffering" is known as "general damages" and you try to put a number on that which satisfies you.

The attorneys who advertise on radio and TV, who will glady take the same 30% to 40% of your settlement that you could get on your own without them, may have some added value if you actually cannot resolve your claim with the insurance company amicably. But unless you have been permanently disfigured or disabled, your claim for general damages might be worth 2 to 3 times your special damages, nowhere near the millions.

Has your case already settled? If not, you can contact any of the following: state bar association, state dept of insurance, insurance company, local district attorney, or write a letter to the judge/court handling your case.

If it has, you should start with the insurance company that paid your claim and ask them for assistance. They will either handle it or refer you to the proper authority. Separately, you should also file a complaint with the state bar association.

I know more than likely no one is on this thread anymore but I read what Max has written.

We were recently rear ended while sitting at a stop light by a drunk driver...multiple offender I might add...legal driving with insurance multiple offender. He never even slowed down. Hit us full force and my husband saw it in the rear view mirror said it actually looked like he was speeding up as my husband tried to get us in the center lane..but all he had time to do was turn the wheel so we didn't fly into the people in front of us. We flew about 20 feet.

My little car is totaled..I loved that car. We were injured but all soft tissue damages..at one point they thought my spleen was bruised and I might have messed up some cartilage around my rib cage. I have to go back for more follow ups. My daughter who was just learning to drive and was to get her license the next day has flashbacks when a car comes up to fast behind her at a stop light. She hears the metal crunching and the pain when she hit her head. And my husband had soft tissue injuries and missed work.

At first the drunk driver refused to contact his insurance company and they told me they could deny our claim even though we had a police report and he was arrested for it. We went through our insurance company for my car, which gave me top value for my car. I thought I would have to negotiate even with my company but their first offer was higher than all my research indicated. His company has to send me a check for my deductible. And while it irritates the crap out of me I have to go try to find a car as good as mine I am glad that part was settled quickly. I loved my car, paid off, no mechanical problems ever, perfect for what I needed and they no longer make that car.

We thought about an lawyer for the PI and punitive damages which our state allows for drunk driving accidents. We even went to have a free consult with one. Then it hit us what our liability limits were in our state. That there were three of us...and then what cut would the lawyer take. We were seen at our military hospital (husband is retired military) so we are unsure how they work to recoup their medical bills. We have decided to go it alone to start with. I have researched online about laws in our state..about what I have to do for his company and what I don't have to do for his company.

We are going that route first because if we go the lawyer route an he only has the mandated state min car liability the lawyers would get more than us. When in reality I am a good researcher and I have time to get all the bills together, I have the medical records today together already, I have the police report, pictures of my car, pictures of the bruises...Why should I pay a lawyer to get these things?

Also we are related to two insurance agents..one owns an agency that the guy has but in a different state across the US and then an insurance adjuster. Although they are different states and different laws they have told us what to say and not to say, what to get and what not to get...And how in our case with a multiple DUI offender the company will not want to go to court so they might want work with us a bit more before lawyers become involved.

We are only weeks into this..not even a month. So we will see how it goes...everyone heard "Drunk DRiver" and everyone yelled "LAWYER" back at us. But I also didn't want to call one of those "call me call me" lawyers you see on TV and I didn't want a lawyer in town who takes an injury case and turns around and defends a drunk driver. So we are seeing how this goes.

This is just my opinion....and I know everyone's cases are different..I just Agree with what Max said.
