| While stopped waiting for a red light to change a large awning on wheels blew across 6 lanes of highway and caused almost 5,000 dollars in damage. The weather front was a forecasted event. I believe that the object should have been secured. Would this be considered an "act of god". I think that I should have a claim for diminished value on my vehicle. |

| No, I don't think this could be looked upon as an 'Act of God'. If the visibility was so poor then the light wouldn't have been visible to other too. Also, it was the other party's responsibility to drive slowly under such weather conditions. |

| Not a lot of info... but I'd think anything with wheels should not normally blow around in ordinary wind. A front is not like a tornado hit out of no where. |

| This was actually an awning that is used in a cemetary to shade people during the burial ceremony. Its on wheels so it is easy to move about. It was not being used at the time and the wind blew it a couple of hundred yards where it crossed multiple lanes of road and ran into my car. I understand a tree falling down is an "act of God" but not tying down an object that is probably 20x30 feet seems to be negligence to me... |

An act of God is most often defined as a natural occurrence that is beyond human control or influence. Such acts of nature include hurricanes, tornadoes, floods, and earthquakes. This would most likely be a claim against the cemetery where the awning blew from. _________________ Ted Taylor

This is what insurance companies like to rely on when they can't come up with a real reason to deny a claim.

| Ya know...I've known people who have gone to court and were being sued for their negligence for something. Just seems like there 'defense' was "the act of God". I don't really see how anyone can PROOVE something was 'the act of God' (just thinking outloud here..I suppose). |
