Auto crash no insurance other car was insured

Hi i was recently in a car crash in my parents vehicle that had coverage on them but not for me, seeing as i was exempt from the insurance.. the lady who hit me also had the same insurance company and had full coverage.. but now the insurance company wants to sue me and my dad for the costs that they had to pay, are they in the right?

What you posted is vague and/or makes no sense. A company does not pay someone money and then spend money in suit to take it back. They simply would not pay it to begin with. Much information is missing.

Also, your dad was insured.

okay i was not insured under my parents insurance policy, it listed me under exempt or something like that..

the insurance company that SHE had paid for her repairs because she had full coverage..

that same insurance company which just so happened to be my parents insurance company is sueing me and my dad because i was not listed under the insurance therefore i was not insured they are trying to recover 7000 dollars that they had to pay to get her car fixed

You are slightly incorrect.they are to _pursuing recovery_ because you caused damage to their insureds vehicle and they paid for that damage. They are requesting payment from _you_ because you were not insured for the accident. Is this right? If I hit your car do you think I should pay you for your loss or you should just pay for it? You were driving without insurance... choosing to address damage you caused yourself.

If an excluded driver clause will hold up in your state is a different matter. You may want to search for case law or hire an attorney to find out.

yes thats correct
i live in California

there was no police report filed because the police officer said that no bodily harm was done and to take care of it with the insurance company..
