Are you covered in an accident with a suspended DL?

by justin_bobier » Fri May 06, 2011 12:02 am

DL is suspended last feb. of 2011. I was hit from behind on 5/1/11. I have progressive insurance and the people that hit me have wawanisa insurance. I filed a claim, and i plan on seeking medical treatment for my back that feels sore. The damages to the back of my car are estimated to be about $500 to repair. Will the drivers insurance(wawanisa) pay for damage to my car and take care of my medical bills as well as any pain and suffering. Or can they say no, you shouldnt have been driving.

my license was recently suspended. I do not ever drive unless absolutely necessary

Excuse me. But when one's license has been suspended, there are no necessary times for driving. Well, maybe if the neighborhood is being evacuated, but even then the answer should be, "My driver license has been suspended. Do you have someone who can take me and my kids to safety?"

Since it was only me involved and it's not like I was just driving to go shopping or something

Driving to go shopping is bad, but driving kids around town is OK? Driving is not a constitutional right. It is a state-granted privilege. You were driving when you were not lawfully permitted to drive, the state having taken away that privilege. But you are a scofflaw of the worst type: one who believes the laws were intended for other people, not you.

I fail to understand why you think it's OK to drive on a suspended license for some things and not for others. You had a seizure and totaled your vehicle. I don't suppose the reason your license was suspended was because you suffer from a seizure disorder and have previously blacked out behind the wheel?

When it comes to my kids I will do what is necessary to take care of their needs

And what need is served by you driving on a suspended license? Children have legs and feet, they can walk to and from school. I did that mostly for the 13 years I was in the K-12 grades. If you don't think they can traverse the distance safely on their own, then you need to walk to and from school with them -- four one-way trips per day. But driving? Not until your suspension is lifted. Once the DMV gets the report of this "collision" on a suspended license, the state could choose to terminate your driving privilege permanently.

Your comments are completely irrational. What would have happened if you had picked your child up from school before having the seizure and your child was killed or critically injured because you had a seizure? Your children need a mom that obeys the law, not one who teaches them that whatever you want to do at the time is OK for you.

[I] don't feel that I should have received the response you gave me trying to make me out to be some idiot!!

tcope already answered your question. If you have collision coverage, your claim will probably be paid. But the insurance company could also look to see that your license had been previously suspended and say, "You were supposed to let us know that your license was suspended, and we would have terminated your coverage at that time as a result, so we are not going to cover your loss -- your insurance has been retroactively cancelled."

That may be the best thing that happens to your kids until you mature into a law-abiding adult.

You are not an idiot. You are worse than that. You are a danger to society and to your children. But in your mind, you think the law doesn't apply to you, only to those who don't have a reason to drive without a license.

I guess your children will not be safe unless you are locked up behind bars. But one or more of your children will probably have to be injured because of your unlawful behavior before that happens. I truly feel sorry for your children.

I never once said it was ok, but I do not have anyone here who can help. Like I said, I am a single mom of 4 who just moved to a small town to get away from their father. It's always easy to say one thing when you have no idea what it is like because you have not gone through it. I understand what it means to have your license suspended and I do follow the law. This was a one time deal and it happen to be the wrong time. I have prayed to God everyday since that did not have a child in the car or that I did not hit another car and injure them, only myself. I just wish people would not judge and just simply answer the question asked. Until you have actually been in the situation yourself because you have kids and do not have any help and are stuck, but have to help your kids, then I feel it would just be best to answer the question and keep your rude comments to yourself because you do not know what is going on in everyone else's lives, only your own!

And my license was not taken away because of a seizure disorder. That was a freak thing that happened that had never happened before. And yes the law does apply to me and everyone for that matter, I was simply trying to explain that my child had to get to school for an extra-caricular after school or she would receive a failing grade. And no my kids are all too young to walk to school. There is no reason for you to belittle people, especially when they already know they did wrong that they are already going to make sure they will not do again, but just want to ask a simple question.

When you learn to quit rationalizing your behavior, you will be on the path to recovery from whatever ails you.

Until you have actually been in the situation yourself because you have kids and do not have any help and are stuck, but have to help your kids

With a suspended driver license, why would you put yourself and your children in a situation where you must violate the law? You chose where you are living knowing that problems would arise.

keep your rude comments to yourself

Don't ask for sympathy here. This is not the Dr. Laura show. You asked a question and you received a correct answer -- twice. No one has been "rude" to you, you just don't want to hear or accept the truth. That's a psychological problem that can be dealt with professionally by someone other than an insurance agent or claims adjuster. I think you will be happier posting your questions at pityparty.com.

You opened yourself up to the honest criticism which has been expressed -- not of your personal situation, but of your behavior in that situation -- because we are insurance professionals who constantly wonder why people act irresponsibly and expect the world to revolve around them, and want others to sympathize with them without cause.

Until you have your full driving privilege restored, you need to live within walking distance of the services you and your children need -- school, groceries, health care -- or within walking distance of public transportation that will get you there. There is no justification, even under God's guidance, for what you have done to expose your children to the danger you pose to them by driving without a license.

God did not tell you to drive without a license, he only allowed you the free will to do so. He knew what would happen -- you did not. Just like you won't know what will happen the next time you make such a selfish decision and put yourself and everyone around you at risk. Your children will not be better off with a dead mother, and as a mother, you will find life difficult, to say the least, knowing that you were responsible for the death of your child(ren). Which of those choices would you take to your grave?

extra-caricular after school or she would receive a failing grade

Excuse me? Extra-curricular means it has nothing to do with one's grades.

And no my kids are all too young to walk to school

If your child is in Kindergarten or a higher grade, they are not "too young" to walk to school. They may need to be supervised, but that's a different matter.

I do not have anyone here who can help

So why are you where you are? Why would you place yourself and your children at such risk? The only answer is that you are being selfish. Whatever you are doing is not to "get away" from your children's father, but that, too, is a convenient excuse. You have your own, unexpressed selfish reasons.

That's the same question my wife and I asked of our son's ex-wife when she moved with our two granddaughters to Spokane WA without a place to live, any relatives within 150 miles, and no job. At least her driver license has not been suspended (as far as we know). And it only took her a few weeks to decide to move back to a place where she can leave the girls with their other grandma (her mother) while she goes off to do whatever it is she wants to do, since she still has no job. At age 30, she continues to display her immaturity. At least the girls can look to the example of their grandma, who works, cares for them, and cares for her diabetic husband who has already lost one leg (due to a terrible accident 12 years ago, not to his diabetes). She is truly a saint, and we try to help as much as we can, but we're 1200 miles away.

Such acts/actions are completely irresponsible and selfish. You can continue to use your children as an excuse for anything you choose to, but it's just that, an excuse to do what YOU want do.

Grow up -- quickly -- and set a proper example for your children, or there will be four more adults with behavioral issues in the years to come. As Jack Nicholson's character said to Tom Cruise's character in "A Few Good Men",

You can't handle the truth!

Coming or going? Which one was it?

and

Why is it not hard for me NOT to believe any of this? I'm sure you drove to the market to buy groceries on many occasions with your suspended license. And who knows to wherever else? Driving with or without a license was something you did as a matter of routine until you crashed your vehicle -- far from being a "one time deal".

You tell so many lies -- including those you tell yourself -- you cannot keep even this one incident straight in your own mind. You are, as I have said, a danger to society. Get help before it's too late. Please! For the sake, safety, and future sanity of your children . . . get the professional help you need. Even where you are, there should be free resources available to you -- through your church, or through county or other non-profit mental health agencies. But you'll have to walk, ride a bike, or take the bus.

! When it comes to my kids I will do what is necessary to take care of their needs

Like not making them walk home like every other child who is close enough not to need to ride the bus? What happens when you accidentally injure a child in another vehicle? Do you plan on paying out of your pocket to compensate them for their medical expenses? I guess your child not needing to walk home is more important.

I was simply trying to explain that my child had to get to school for an extra-caricular after school or she would receive a failing grade. And no my kids are all too young to walk to school

This does not add up. A child is too young to walk to school but for some reason could get a failing "grade" if they don't show up to school in the evening?

. There is no reason for you to belittle people

When someone points out that you should not be driving... and there is no _good_ reason for you to drive and it sounds like they are belittling you... there is a reason for that. It's because you think it's perfectly find to drive without a license with a young child in the car because.... you think your child needs to get to school in the evening (which I still don't buy into). To me it sounds like you are simply trying to justify your wrong doing. On top of that you were involved in an accident. There is a reason your license is suspended. It usually happens because there is some issue with the person's driving record/habits. Sorry if this sounds insulting but its simply the facts of the matter.

MaxHerr, you obviously have never had your license suspended for a reason completely irrelevant to driving/anything medical that is inhibiting you to live your life in a place with little to no public transportation and no family/friends to help.
Stop judging everyone's lives.

MaxHerr, you obviously have never had your license suspended

You're right. Never happened, never will. Because other than maybe driving 10 mph or so over the speed limit on the freeway, that's just about the extent of my lawbreaking activity behind the wheel these days -- that and an occasional foray into the carpool lane with no passengers. Now, 30 years ago . . . I'll admit I did some pretty stupid things when I was alone in my '81 Honda Accord on the freeway or a deserted stretch of road, but I never had an accident and I never wrecked a car. But I did manage to gather two (or was it three?) speeding citations in a couple of months that calmed me down a bit.

But my driving habits are not the issue, it's your lack of acceptance that you have only yourself to blame for where you live, what you have or don't have in the way of family support (and I think I know why your friends are on the thin side, too), public transportation, a valid driver license, or, finally, a car to drive since you totalled yours driving unlawfully on a suspended license while you were either

(a) on your way to pick up your daughter
or
(b) taking your daughter to school

[choose one of the above, because you have claimed both as the reason behind your one accident]
. . . for a 2nd grade make-or-break-her-academic-career-extracurricular activity.

license suspended for a reason completely irrelevant to driving/anything medical

OK, let's see what the choices are.

License not suspended for anything relevant to driving
License not suspended for anything medical

License suspended for . . . some criminal activity? No, I don't think that would happen.
License suspended for . . . not paying child support? No, that doesn't work either, since you have custody of them.

Gee, Amanda . . . you win the prize! I'm completely baffled as to why you have lost your driving privilege. Maybe you'll tell us one day.

Stop judging everyone's lives.

Unfortunately, no one is judging your (or anyone else's) life. Just reporting the truth, ma'am. But, as I have previously stated, you cannot handle the truth. You want the rest of the world to dovetail into your fantasy that you are the victim of some grand conspiracy.

Well, as Dr. Laura would say -- and you know, she's gotten to be a whole lot crabbier now that menopause and old age have set in -- Honey, you need to grow up and take responsibility for your life, set a positive example for your children, and stop blaming the world and everyone else in it for all of your bad decisions.

We do not hold, or entertain the thought of, pity parties here. We read what people write when they ask questions and we respond to what they want to know. That has been done at least three times now in your case. Everything other than that is simply intended to get you to see what everyone else around you sees . . . a spoiled adult acting like a child because no one will sympathize with the situation she has made for herself.

And it ain't gonna happen here no matter how much you rant and rave. Hopefully, your children will find another role model to pin their futures on, because your examples are not in their best interest.
