Are you covered in an accident with a suspended DL?

DL is suspended last feb. of 2011. I was hit from behind on 5/1/11. I have progressive insurance and the people that hit me have wawanisa insurance. I filed a claim, and i plan on seeking medical treatment for my back that feels sore. The damages to the back of my car are estimated to be about $500 to repair. Will the drivers insurance(wawanisa) pay for damage to my car and take care of my medical bills as well as any pain and suffering. Or can they say no, you shouldnt have been driving.

You don't need a driver license to collect for property damage or medical expenses. But you need insurance in this instance in order to collect for "pain and suffering".

Why do you believe the law that requires others who drive to be licensed doesn't apply to you?

A relative of mine had her license revoked last year in CA. The DMV says due to her medicines, she is not safe to operate a vehicle. She was on her way to the hospital for surgery (I know, she should have had someone else drive her) and she was rear-ended while at a stop light. The other guy was going 55+ when he impacted her. Will his insurance cover her injuries and the loss of her totaled car?

The at fault driver remains responsible for actual damages to property and any medical expenses due to injury suffered in the collision. What your friend cannot receive is compensatory damages for "pain and suffering" unless she has auto insurance.

The problem is, in a civil trial, her negligence for driving without a license (even worse, a revoked license) will probably outweigh the other driver's negligence under CA comparative negligence statute. She could be found to be more than 50% at fault for simply driving.

Hey,

My fiance was involved in a car accident a couple days ago he was turning left when a buick t boned him. He had a yellow light when he went to turn and the guy that hit him had red. There was a officer behind the older man that hit my fiance and when the accident happened and all parties got out the cop told my fiance he did not see what the light was and both parties claimed to have the go light. We finally got the accident report and the office put that it was my fiance fault that he had ran a red light. Now I was seeking advice because on the report is startes the time of the accident was at 11:50 when I know for a fact that it happened at 12:00 bc he was on the phone with me and the call ended at 12:02. The older guy that tboned my fiance was also driving with a revoked license. He also told my fiance he was looking in his review mirror and when he looked up they hit. The report states the damages to our vehicle (vw) is 4000.00 and 1500.00 for the other vehicle. The officer also so that the buick was traveling at 25 mph when he hit my fiance. 



We'd like to take him to court because alot of the things on the report dont add up and my fiance had the yellow

We live in North Carolina.
