Should have been totaled, what now?

Total front end damage. When I saw the car I thought it was totaled. Fluids leaking drivers side of the front end was the worst. It is a 2010 Nissan Rogue 360degree with AWD. The car was in perfect condition prior to the accident it only had 15k miles. Initially the body shop the ins co referred us to said 8500.00 damage & 3 wks to repair. The car was initially returned 4 wks later, rental coverage exhuasted. It's now on it's 5th return for something that was missed, it's now at the dealer it was purchased from for repairs, the ins co is disputing paying for a rental and the damage is well over 20K. Our concern is it will never be right, the value diminished, when the car should have been totaled from the beginning.

Gerry, where are you located and was this your insurer or the at fault insurer. Did you choose the shop or were you coerced into using this shop and was it a preferred shop or direct repair shop of the insurer?

We live in a suburb of Chicago, IL. it was my daughters fault, she rear ended another car who at the last second decided to turn left in front of her, at the exact same time my daughter was distracted by her dog who was in the car with her, she hit her at probably 35-40 miles per hr. The shop is the preferred shop of our insurance company. The accident was March 10th, so we're at almost 11 weeks and still don't have the car back. They've told me on three separate occasions the car had been gone over "with a fine tooth comb" and each time there was another problem. What they've got into the car at this point almost ibut pretty sure it does exceed value. We have State Farm so it's not like it's sub-standard insurance. The value of the car is less because of the accident if we were to try and sell it, at this point I just don't know what to do. The last time the car broke down on a freeway, she was almost rear ended multiple times, I fear for her safety.

Send me a private message and I will give you the name of someone n Chicago that can perform a post repair inspection to determine whether your vehicle has been restored to preloss condition as your policy promised and whether the shop and insurer did the best of their ability to ensure that was the case.

I believe you can legaly pick whatever shop you want to go to (that's how it was with me when I had my accident). Sure sounds like te body shop did a horrible job if you have to take your vehicle back several times!!
