Can an insurance A. sue me for money I dont have?

Im completely inept with knowledge on insurance. Just F.Y.I

Around February-March this year I was involved in a road collision with another truck. I was turning left into my friends driveway just a meter or two from the apex of a hill when the other truck just appeared and smashed into my front right fender and passenger door. It is a terrible blind spot and the speed limit on this back road/residential is 40mph. His truck was considered totaled while mine just barely made it.
The problem at hand is that I found that my truck was not insured but i as a driver are, under my step fathers insurance. This was my first vehicle(car/truck) i had ever bought, fully paid off; and was relying on family to help me with what i did not know. The title of my truck is under my and my grandmother's name because im a broke college student with no credit. The insurance agency(s) as claimed it as my fault as well as the officer saying i made an illegal left turn when there are no signs stating that on said road. I am now getting mail from the apposing driver stating i owe them money i my self do not have.

Besides the truck the only thing I own my self is a motorcycle, on paper. Can they drain the money from me though i do not have it and/or can they go after my family? Also I need this taken care of so i can continue my enlistment in Air Force, this is only thing holding me back at the moment.

Makes no sense that you'd have yourself listed on an insurance policy but not have the vehicle listed. There probably would not be any additional cost to add the vehicle as you are already insured for liability. Have you reported this loss to that carrier to see if they will extend any coverage?

The other carrier can go after you... but how depends on the carrier. Most likely they will send/sell the debt to a collection company. What the collection company does depends on them and the state laws. If it's enough money they may want to file suit. If they obtain a judgement then it depends on state laws as to what they can do with that judgement.

You really can't know what they will do.

I can tell you that you can always make a deal with the insurance company. They would probably take much less up front or you could set up payments. If you wait and they sell/turn over the debt to a collection company than you may have less power to negotiate.

In the real world, people who are broke and have no credit do not drive cars, they ride the bus.

Yes, that's exactly what will happen if this goes to court and a judgment against you is ordered by the judge. Until then, the answer is no.

Probably not. Except for your grandmother, whose name is on title. Such a nice thing for her grandchild to do to her in her old age, isn't it?

Maybe you have family or friends who can provide the money you need -- broke college student that you are. Or you could consider getting a job and paying your obligation with your own money (the adult, responsible thing to do).
