Next step after submitting all claims and certified letter.

MVA 2 years ago in Mississippi. Other person clearly at fault. Have submitted all requested information to other party's insurance. Suffered life changing injury, broken neck at level where most people do not survive or live life as a quad, but praise God survived with permanent limited range of motion to neck and life long pain. All substantiated by 2 different physicians. Submitted certified letter requesting payment to the highest level of their clients coverage 3 weeks ago. Lost wages, medical bills and future medical. In halo brace for almost 4 months, out of work for 6. (The amount of other party's coverage has not been disclosed.) Still no response. Insurance did pay off my vehcicle shortly after the accident, but nothing else. There is a 3 year limit. What is the next step? Am i correct in my understanding that her insurance company cannot pay anything above the amount of coverage their client carried? Am trying to avoid hiring an attorney. Have received legal advice that this is easily a 6 figure claim.

My recommendation is that you call the adjuster to find out the status of your demand. Sometimes attorneys will put a time limit on the demand. Usually demands are responded to within 30 days (pretty much the standard). If it's not too involved it usually takes 1-2 weeks. I have a demand on my desk right now that is 8-10" tall around 700 pages. Attorney called me a couple of days ago as I've had it for 2 weeks. I asked for 10 more days.

You are correct that the carrier will only pay up to their policy limits. That is not to say that the claim is not worth more.
