Is my neighbors Homeowners Insurance responsible for damage?

Hello, I currently rent a home in Ogden, Utah. In late November 2011 there was a severe wind storm that hit us and in the process my neighbors shingles flew off his roof breaking 3 windows of my Suburban. We reported it right away and many pictures were taken. It is now almost Feb. and our neighbors insurance is saying they are not responsible because it was an "Act of God" and we can only count our losses. Isn't that exactly what Homeowners insurance covers? Damages caused by "Acts of God"? Another thing is that it's our Landlord that is dealing with our neighbors Landlord. So their response to our Landlord was "it was not your car that was damaged." So are they saying that I should go after them myself? Either way, shouldn't it be covered regardless of who's car his roof damaged? Please responde ASAP. Thank you!

Kind of... yes, this is what _your_ homeowners is for when addressing damage to _your_ home. The other person's homeowners addresses other peoples damage when their insured is _legally liable_. Side note... "Act of God" (specifically) is not a covered peril under your homeowners policy.

Here is your question... what did your neighbor do that was negligent?

100% correct... your landlord should not even get himself involved in this matter. He's not a party to anything.

His homeowners carrier is 100% correct, six ways to Sunday. See my question above... what did this neighbor do wrong?

This is why you have comprehensive coverage on your vehicle... to address damages to it.

You can feel free to file suit against the home owner. His insurance company will provide a defense and I can guarantee you that you don't have a case.
