my car was paid total loss in march, car was only paid this amount because insurance co said value was less than damages, however they gave $1700.00
Car hit in january total new area with $4600 damages to this car and insurance sent me a check for $357.
this is crazy, can i sue the driver, and insurance of the damages or rest of payment for total loss car,

| You obviously left a _lot_ out of your post. Why is the second carrier only paying you $357? I'm guessing either they found out it was a prior total loss and/or discovered that it was titled as a salvage vehicle due to the prior total loss. Usually a vehicle that was a prior total loss is going to be worth 25% less then it's prior total loss value. In this case that takes the $1700 down to $1275. Did you not have the prior damage repaired? This is going to lower the value even lower... probably to the point where the vehicle's value is solely in the fact that it's still running... which is a typical value of $300-$500. |
