My sister let her boyfriend drive my vehicle without my permission and they hit a parked car. Its been a year ago and I am just now getting a letter from the other parties insurance company I am being sued for 7grand after my sister told me the people they hit had no damage. My insurance had lapsed by a week and my insurance denied my claim for my damages because of it. As far as the other parties damages am i responsible in the state of texas since i wasnt driving and didnt give permission to let him use my car. also they sent me a threating letter saying that any uninsured driver may have there licensed suspended there was a police report the insurance company should see that I was clearly not the driver or at the scene of the accident can they suspend my license even if i wasn't the driver?

I was in a 3 car accident, being the last car to have to slam on brakes and clipped second car when they slammed on brakes to avoid an accident. Since I was uninsured and had to pay for the second car bumper..it has gone to a Recovery group as a subrogation claim. They are wanting large monthly payments and threatening to suspend not only my license if can't pay requested monthly amount (and won't work with me) but said could suspend my husbands license since he a registered owner as well. They said they can do this in less than a day. One, can they suspend my husbands license even though he wasn't in accident. Secondly, what is the procedure this company must follow to suspend any license in Ca. Would so appreciate a quick reply as I have to call them back with an answer by 6pm pacific time today. Thank you.

This is a scare tactic and is a violation of the Fair Debt Collection Practices Act.

The only one who can suspend a person's driver license is the DMV (or a court). No collection agency has the power to do this -- not in one day, not in a thousand years.

You should report the FDCPA violations to the CA Dept of Consumer Affairs, the CA Attorney General, and the Federal Trade Commission. I also recommend that you write a letter to the collection agency and tell them that they have violated the FDCPA by making threats of legal action which they have no possibility of carrying out.

Please help, I am curious to know how this situation worked out for you in the end(if it has came to an end) I am in the same boat as you were I am searching online for answers and I came across this it sounds almost exactly like what I am going through except 9 months after the accident they went back and "claimed" to have personal injury increasing the amount being sued for from 6grand to 20. The only person I am asking for a response from is the author of the original post unless you have something to say that will help me. Everyone else with negative answers can keep their opinions to themselves and go find another question to answer

Don't hold your breath waiting for an answer. The OP posted as a guest and will not know you've asked a question.

No reason to be so nasty.
