Rental Car Insurance after fender bender

I was a PERMISSIVE driver on a vehicle which was slightly damaged - bumper. The other driver and her insurance company accepted liability for damaging car's bumper though I was substantially inconvenienced by it - two separate body shop estimates and then the back and forth to drop off and pick up the car at body shop.

They authorized payment to the rental car company, for the cost of the rental. But because the damaged vehicle only provided Liability Insurance to me or any other driver, as a Permissive Driver - that insurance did not follow me to the rental car. Therefore, I was forced to purchase the Rental Car company's insurance package for each day I was in the car - 4 days.

It seems ridiculous for me to be forced to incur hard dollar costs for anything (other than fuel) due to someone else's liability. The adjuster has refuted my request to reimburse me for this cost of approximately $150 and I'm miffed now because that's not cool.

My question is: Can I expect this cost to me to be reimbursed in California? And, secondly, can I expect to be reimbursed for the 8-10 hours of lost time at work because of this?

Max will know CA better then I but in some states it's not required that they pay for the Collision Damage Waiver. What the insurance company owes you for is Loss of Use... the fact that you lost the use of _your_ vehicle. Usually this is based on the cost of a rental car but Loss of Use and paying for an actual rental car are two different things. As this is the case, the requirements of your rental contract (that the rental company requires you protect damage to their rental car that you are driving) do not factor into the loss. As I mentioned, some states have case law that state it needs to be paid, others either don't or don't require that it be paid (as you did not have collision coverage before the accident).

You can certainly ask for loss wages. Be prepared to prove that you actually suffered this loss. Wht 8-10 hours? I'd think it would take you 30 minutes to drop off the vehicle and 30 minutes to pick it up. Perhaps 2 hours. Why 8-10 hours?
