I was sitting in traffic when I was rear ended by another driver on her cell phone she was cited on the scene by the officer, my car sustained $5,090.00 worth of damges and i went to the er the next day with a normous headache which i am continuing having and suffered neck and back strains which i am now seeing a chiropractor, that stated my neck was swollen

Do you have the report ? Save documents for the medical expenses. Forward a collision claim against the other party's policy. Include losses for pain and suffering, lost wages (if any).

Too bad. You will probably discover that the chiropractor will bill thousands of dollars which the insurance company is unlikely to pay some or all of unless you were referred to a chiropractor by your MD.
Aside from that, do you even have a question? You only made a statement.
