I was sued by uninsured driver who had no licensed viol. dmv code 12500 in calif. . I answered during pleadings and they vacated the law suit. my insurance co. to get paid for my injuries at that time was for the pip which I was denied. I filed my claim with them and was denied also went to the dept. of insurance and was denied. they ar4e in bad-faith cause at the time of accident she didn't live at home with her parents so she can't be under her parents insurance as my insuranc claims.so I want to sue my insurance co. for the policy. this now makes it totally the other sides fault since the other side "vacated" this makes it a hit and run as well since we never excfhanged info.. she was pulled over 1/2 hour prior to the accident and she was not arrested she was allowed to dirve with a ticket if she was arrested the accident would have been avoided. should I sue myself or get a attorney? I'm suing for over $300,00.00

This post would be much easier to understand if written in proper format and with proper English.

Let me ask to be clear... who would you be suing? You mention that your carrier denied you PIP but then you also mention if other parties had not allowed her to drive that this accident would not have happened.

Can you sue another party yourrself? Yes. However, if its in anything but small claims court you will probably loose as you don't know the proceedures and they are technical.

However, you never mention why your claim was denied. If you want more information you may want to post that information. It sounds like everyone is "agreeing" with the denial.
