Insurance refuse to cover accident

My insurance company refused to cover a rental car i rented in on the grounds of having the car for regular use. It was a hit and run and I was not at fault so I also thought uninsured motorist would cover the rental also but I was told no by the claim adjuster. The adjuster only attempted once to contact the other driver.

First, have they sent you a denial in wiriting? If not, then the claim has not been denied. If the sent it in writing did it really specify that the denial was due to regular use? How long did you have the rental? Why did you have the rental?

Hit and run... but they called the other driver? So they know who it is? What is the story behind that? Was their a police report filed as this was a hit and run? Did they list insurance on the police report? What indication is there that the other person _does_ have insurance?

They didn't send me the letter of denial they sent it to my passengers lawyer. He was hurt in the accident and started his medical treatment but was denied. I asked about the other driver and was told she was told that he sold the vehicle. She never looked farther. Yes, I completed a highway patrol report and they looked up the license plate that I found and informed me that the car was tracked to a salvage shop in Cerritos. I called the salvage shop and learned he purchased the car from nesters auto on July 17. When I called Nester he said he has to look for the paper work and for me to call the next day. I called the next day and was told he stil has not got the paper work so I returned to the highway patrol office to file another supplemental. Currently I'm waiting on the investigating office to let me know who sold the van and when. Oh I had that rental for 4 weeks but I also had another one before that it was all on the same contract so it appeared to them that I had the same car for longer. I returned to Enterprise to get proof but they didn't care. My policy does not specify the amount of days to have a rental but I rented it so my car could get worked on and I went out of town.
