I was parking my car and I was hit by a teenage driver with a permit. My insurance was canceled at the time and I recieved a phone call from her insurance company requesting that I make a 2,000 dollar payment.I know I was wrong for not having insurance but I know it wasn't my fault,What can I do??Your advice will be greatly appreciated.

Depending on the state determines the process but ultimately the other carrier would need to prove that you were at fault (which is appears is their opinion since they are asking you to pay for their insureds loss). Was their a police report filed? Were their any witnesses? You can also provide a defense. Do you have any proof/indication that you were not at fault?

It's really a question of how far the other carrier wants to press the issue. have you ever spoken to them about what happen? Perhaps you want to give them your verbal statement (personally, I'd not give a recorded statement, just a non-recorded one) and let them know your side of the story. Do you have any facts or evidence, such as an area of impact that would corroboration your version of events? You may even want to write a short letter explaining why you are not at fault. Perhaps if you give them enough reason for doubt, they will drop the matter.

There is always the possibility that they will press the issue. I can say that I've never heard of a carrier pursuing $2,000 through the court system. It would cost them twice that to obtain a judgment... which would still not mean they'd collect. Some states allow the carrier to suspend your drivers license (some may not). I'm not sure if this is possible in your state or how exactly this works, but I'd imagine you'd be given some sort of rebuttal before it was done.

Now... you have gone out already and secured insurance, correct?
