Actually the U.S. justice system would have required a civil suit regardless if the OP intended to pursue this in a court of law. The two options would be sue the insurer or sue the alleged name switcher. Criminal court wouldn't overturn a life insurance contract payment. 10 bucks says there's not a prosecutor or criminal defense attorney out there who is all that well versed on insurance law. Reason being they don't need to be.

True, but a forgery conviction or some other criminal conduct for which a person is found guilty (by other than a plea of nolo contendere) is essentially a free pass to a civil judgment. Just have to present enough evidence to establish the value, don't have to prove who's responsible.

Generally speaking, there is no statute of limitations on life insurance death claims, as long as the policy was in effect at the time of death.
