Can the other driver's insurance be cancelled at 10:30 am?

I was in an accident and it was the other driver's fault. He harrassed me for about two miles and then cut me off and slammed his breaks to make me hit him. Now his isurance is saying that they are not liable for personal injury because the insurance was cancelled 1 hour before the accident which would be at 10:30 am). Even though, the have already sent an adjuster for my car and dicumentation for us to have it fixed. Now what?

Has the denial be issued by the insurance company in writing? The claim has not been denied until it's in writing.

A policy cancelling at that time is very unusual as policies usually end at midnight.

If the other person is at fault and does not have valid insurance, you would either need to file the claim under your collision insurance or UMPD if you have it (if you are on MI this is mandatory) and have them pay for your loss and pursue recovery or pursue recovery yourself probably through the court system. Small claims court would be the easiest. You will need to be able to show that the other party caused the accident.

OP, where did you get this 10:30am cancelation information? and even if so their insured (bad guy) should've had the option to renew it so this loss would've been covered...

As Tcope posted though, you might have one devil of a time proving this guy (rather than you) were at fault for this accident..
