Hi there anyone can tell me who is to blame I was driving a road that had to lanes approaching a round about in the near side lane to go straight across went round the round about to leave when a car came from the outside lane to go the same place I was going and we just about avoided each other. I sound my horn, flashed my light and shouted to my astonishment she was on the other side of the road and got a lot of abuse back. Now this was not the end of it she started to slow down and I thought she was going to turn right so I ended getting close again then she drove off she was not going that fast and I was gaining on her she then put her brake on and stopped dead and I went into her. I got out she got out she said my car is ok I asked for her insurance she stated to get back in her car I said there is 3 witnesses and she drove off we got the reg the police were called they had a job locating her. Now these 3 witnesses have told the policed she jammed her brakes on to the extent that she skidded. She is telling the police I was driving to fast. Also there is a speed camera where this took place .

Certainly can't tell from that "description". It hurt my head to just read it.

It sounds like a case of road rage...and it sounds like anger got the best of both of you...she slammed on the brakes and you hit her. In some states, a rear end collision is almost always the fault of the back car. It sounds as though you both contributed to the accident, and it certainly doesn't seem like she'd get very favorable treatment considering the fact that she left the scene of an accident.

Is the accident your fault...legally maybe not...otherwise yes. Next time calm down and let the person go about their business and you do the same.

Hi everyone thought you mite like to hear that I won this case she lied to the police officer and changed her statement in court. She also claimed she over took me before the round about on a dual carriage way that is 1/10 of a mile long. considering she claims at the time she was doing 40 miles a hour amusing I was doing 30 miles not possible.

While negotiating with the insurance company, you simply got to make a reasonable argument and try and convince them that it was due to the other party's negligence that the accident had occurred. However, a lot depends on the investigation reports too.

It sounds like this was a traffic court hearing, not a dispute/resolution with the insurance company
