Cash pay-out

I'll try to make this as short as possible.

I'm the victim of a parking lot rear end accident. The guy who hit me has admitted all liability. I've gotten an estimate at a shop of my choosing. His insurance company (AAA) sent out to my house an independent appraiser. She did her report but failed to include pictures of the most expensive damage (There's a difference of $500.00 comparing her report and the body shop that I took my car to). After I received the appraisers estimate I called AAA and they said that if I wanted a cash pay-out I would be the one responsible for getting the proof that the part the appraiser 'conveniently' left out was really damaged. This would be at MY expense. AAA, says that my bumper has to be completely dismantled to prove this. I say, BULL!!!

U see, the problem is, it's my car that got hit. If the other party has admitted all liability I shouldn't have to pay a dime, not to mention that it's none of AAA's business if I get the car fixed or not. Am I right?

BTW, Totaling the car out is not an option seeing as though it's worth much more than the damage caused. This is not in dispute.

I live in California.

PS, I know and have met J D Howard, and he personally told me I was wasting valuable time arguing DV with anyone on this board as it was promoted by the insurance industry who refuses to recognize DV. Lori and T are actually pretty sharp in my book, but J.D. Howard has worked on both sides of the industry in Insurance Claims and as an independent adjuster at some of the highest rungs in the Insurance field. Lori and T might be pretty sharp but they are no J.D. Howard.

You wouldn't, oh no mike, i corrected that...besides, you've got more intelligence in your little pinky than this one, AND more class..First Mike you know I've never argued that MO doesn't recognize 3rd party dv...that's not to say they pay it on VIRTUALLY EVERY 3RD PARTY REPAIR, though...And as far as paying it when the actual loss occurs (when the vehicle is sold or traded) is my opinion only...that is when I think it is owed, when the actual loss occurs..I've never said that I knew a carrier than handled it that way, and if anyone took it that way, that was not my intent AT ALL...It is my opinion that is when it should be paid, period....
I'm sure you will admit that dv would be much less five years after the repair was made, the vehicle is five yrs older. and that (sale or trade) is when the loss occurs...now really mike what about that isn't fair to you? I'm being serious, why is it not far to pay the person when the have an ACTUAL loss? ..

The deflated and diminished price you might receive for the artifact would only be perceived by you as being a loss either when you sold it or the moment it was repaired. In other words you're just imagining you have a loss

No mike, you said it yourself it's 'valuable artifact', i'll even throw in 'priceless' never heard of 'one of them there' that didn't INCREASE in value...where a vehicle is certainly no artifact, nor does it EVER increase in value (we're leaving classic cars out of this ok? we all know that's different)...so they are not apples to apples...now if you said, they had a motorcycle, boat, four wheeler, something like that, pretty much the same...but not a priceless 'artifact' mike...come on i KNOW you see the difference there..

Don't think we claimed to be as sharp or duller, actually I was taking up for him in this thread, and pointed out where 'get' got it....As I remember his bio, he got out of claims before this became a big issue, (that is NOT any type of slam or anything don't take it that way), and he has built a large buisness on dv and other things...I have no bad feelings for the guy think he's probably a great fella, maybe when i retire, or get fired, or quit, i'll hit him up for a job.. :wink: one never knows... :lol:
