Can someone sue me if I was at fault during an accident?

I was in an accident where I made an illegal U-turn and someone hit me. It was determined by the police report as being my fault. The car that hit me was a newer model, and I recieved a letter from my insurance company stating that the damages to the other party might be above my limits. I only had basic liability coverage as I am a very broke 20 year old college student who was driving an older car. Does this mean that the other party is definitely going to sue me or can sue me? If that is the case, I will be unable to pay them so would they garnish any wages I earn? Would I need to file bankruptcy?

Julie there are different views on this...I personally am of the opinion "if the limits are low let 'em know'' if they are high (and a small to moderate injury)..I'd keep my cards close...I'm assuming you are talking with and taking the counsel of your claims adjuster on this as well.

they want me to disclose my policy limits

Who is asking you... the attorney or your carrier? You should not be disclosing anything directly to the other party, your carrier should handle this. Is your adjuster asking your permission to disclose? If so, follow your carriers advise and that info listed above.

This is rediculous. What is the point of suing your neighbor?

First of all Trench, I couldn't agree more

Secondly, the term 'deferred' means to just put something off right? So how is this resolving anything? ...but to answer your question

what happens if he does not accept that and would i need to show to court to testify against him?

yes, I'd say so, but certainly contact the prosecutor...

I am a victim of a car accident. I was hit by someone that made a stupid move also. I am considering sueing her. Not only was my car totalled but I now have to pay difference after insurance paid. I am a single parent of two children and my money is probably tighter than yours. Not only did this ruin my budget, but now I have more out of pocket expenses, rent a car, medication and co-pays etc.

To beat all, due to the current lending situation, even though I have cleaned quite a few things up from my credit report, I am having a problem getting financed. If I can not find a car by the time the rental is up how can I get around, keep my job, or drop the kids at daycare, or go to thsupermarket, etc.

What is the victim is suppose to do?

Yeah, I'm gonna sue the hell out of her

That's not her fault. You were upside down in the car before the accident. That is why GAP insurance is so important.

medication and co-pays etc.

Did you not recieve any money in the settlement for medical?

I was listed as careless driving. no citation. I felt the other car was at fault but officer said I was. I did not have bodily coverage on my policy and he is sueing me for bodily damage. I am on a fixed income and can not afford an atty. The man was not hurt at the scene nor anyone I could see, and he did not say he was to the police that came. No medical need was attended at scene. I have to go to Pretrial on this and do not have a lawyer.can't afford one. what do I do.
