Uninsured motorist claim

I am seeking info on an uninsured motorist claim. I was hit 6 onths ago, a hit and run and have had neck and shoulder pain that will not go away. I ahve had chiropractors work it and MRI was negative as far as any sergury needed. My insurance wants to settle for $5000 dollars if which I need to pay a $1500 MRI bill and would be able to keep $3500. Is this a fair settlement, I have no idea, I agreed to it over the phone, but now think since I am still Hurting that it may not be fair?

If your injury has not resolved to the fullest possible then you shouldn't be settling...as for your question is that a fair settlement for the type of injury you discribed I would say yes it is...However (as I said) if you are still suffering six months later obviously the chiropractor isn't doing their job...

Whiplash usually resolves it's self whether you go to chiro or not within a month or so...maybe something else is amiss?

I agree 100% with Lori... soft tissue injuries being treated with physical therapy won't show any improvement after 2-3 months of treatment. After that and it's just a "feel good" thing. That is, it's really just a massage and does not have any medical benefits.

I think your missing something. $5000 - $1500 = $3500. What the chiro treatment free? I'm betting you might need to pay that bill out of the $5k settlement as well.

Was the $5000 the adjusters initial offer? I agree that it seems reasonable but to me honest, you could milk that up about $500 with little problem. I agree you should not settle until you understand _exactly_ what future treatment will be. But I'd not count on the carrier considering too much additional chiro treatment for the reason I mentioned above. Consider the $5000 settlement and let the adjuster know that you will probably need a a few more visits. Tell the adjuster that you think $5k is a good offer and that you appreciate that they are offering that amount. But tell them you'd be willing to settle for $6k... as you feel that you will need some limited additional treatment and feel that a slightly higher settlement is fair. You may get the $1k but I think it's more likely that they will offer a lower amount (this is why you shoot a little high). If you want to settle for their offer then fine... but you could always let them know you can't settle for that amount and let them sit on the claim for a month or two. Adjusters don't like to leave claims open when they could simply pay a few extra hundred dollars and close them.

I would agree to most of it...& would also like to mention over here that you need to communicate very frankly with the adjusters & if you show up good reasons then you might end up in a real win-win situation!

Is there a set amount for injury by type? Do you get more if you doctor longer? Insurance settlements are so confusing to me, I have a sister who was hurt in the summer, he doctor won't release her yet, she wants to settle because they told her that there is really nothing else they can do with her, just manage her pain, the insurance company won't settle until the doctor releases her. If it is just management now, can't she settle out now?

No not really except of course a soft tissue injury isn't ''worth'' near what a broken bone of scar on your face is worth...

Unfortunately yes, some times...now seeing a PT or Chiro for a year won't help you....

Insurance settlements are so confusing to me

, they are to everyone, even those of us that have to handle them ! :shock:

What ''kind'' of doc? Why will he not release her?

If it is just management now, can't she settle out now?

Depends why she hasn't been released, type of injury etc...NEVER a good idea to settle while you are still treating...

I was in an accident on april 9, 2011 Isuffered neck and back pain ,I had 8 sissionsof PT. I had to call my doctor because I have been gettting headaches every two to three days a week. and Iam still having lower back when trying to do my every day chores. My insurance has offered me a settlement in the amount of $1,156.40. I feel that this offer is not fair and going to send in a counter offer of at least $4,500 along with the offer of their do you feel that this would fair
