The following was left in my mailbox, with no name or avatar, nothing etc....Hopefully the owner will return for answers....

Hi, Lori, I need some info. Maybe u can help. My husband had an accident in Oct 07 and we had no insurance at that time. It was cancelled since we missed payment. We are in very bad situation financially. The other insurance co. sent us a letter asking for $3900 not sure how they come up with that amt. The car tt got hit is minor hit on the side. They threaten to send it to the attorney for collection and revoke my husband driving priviledges.

My questions are can we settle the amt for less, how to do it? If i choose to make payment i do not know how long it takes since we have very little money left afetr bills, do i have to ask how did they come up with the amt? and usually will they provoke the DL?Thank you !!

When the insurance company makes the ''subrogation demand'' they should have sent supporting documents, ie estimate of repair, rental bill etc...Doubtful you will be able to discount this with them other than a full payment, example, you owe them 3900.00, you could offer to pay them 2500-3k in a lump sum to make it go away or make agreed payments until it is paid for....Most carriers will accept payment arrangements....Don't hide, or run, it will always catch up with you...try and work it out with the carrier..

By the way, do you have insurance now?

The insurer normally agrees if you tell them that you want to make payments, because you are at least agreeing to pay what is due. Its probably a collection agency that's contacting you. try to negotiate the matter directly with the insurance company and make your offer. Also ask them for the breakup of the cost if you are not sure how they have estimated the amount.

IMO to counter an attorney, you too need a legal representation. There are some organizations which offer legal aid to people with no-money at a reduced rate or free of cost. You can also try to make the surrogating party realize that you may even bankrupt if they insist you to pay the amount in lump-sum. Honestly, there isn't much to suggest given your financial condition. Hope your problem get over soon.
