the statute runs out in June 2009.. The accident was the fault of the other driver, his insurance company is being completely unfair regarding my settlement. Is there a way for me to protect the statute?

Its really very sorry to hear about this....

Many of the times it so happen that the person who has suffered the losses due to the circumstances may ask skyrocketing compensation which is really a big cause for the insurance company to just neglect the claim.

With due respect just make sure that whatever you are asking as a claim is realistic figure and just fit in the purview of the normal clauses.

If your claim is really a legit one (once again it is not for proving that you are doing something illegal rather i am talking about the realistic approach.)

And still the insurer is denying the claim then you can immediately report it to the insurance commission available in your state and thus it will surely have some impact on the case.

Just make it sure that you are putting it immediately before the statute runs out!!!

Yes, you would need to file suit against the at-fault party. So you'd really need to hire an attorney to file and protect your right of payment. Pretty much no ifs, ands or buts on this. This would need to be done before the 2 years was up.

i agree with tcope that you should get this done asap. get in touch with an attourney to file a case. care to elaborate more about the accident and why you think the company has been unfair. it'll help us a great deal about providing you with more advice.
