policy owner died and was also beneficiary, insured is still living so what is the legal result on this. Is there law that helps the insured win over

The insured never "wins". But depending on the language of the contract, the insured might become the new owner of the policy. This is a contract law matter and is governed first by the law of contracts, then, possibly, by probate law.
