Unemployment after disability is covered if you are laid off

I quit my job because I had a serious illness and couldn't perform at work. I claimed temporary disability for 3 months and now I'm searching for a job. Can I get unemployment benefits while looking for a job in CA? I'm really suffering from this unemployment after disability.

trial work from social security and that is meant to judge how efficient or capable you're at work.

Aside from being grammatically incorrect, the answer is wrong too. The "trial work" period provided by SS is meant to see if you are capable of working with your disability and how much you are capable of earning -- they could care less about your efficiency or the quality of your work. If you appear to be able to earn more than about $1040 per month, you will not qualify for SSDI.

I had a brain aneurism in August. Now, I am okay to go back to work in New York State, but the restaurant I worked for closed down during my time off, ill. Am I eligible for UI in New York?

Only if you are a New York state resident. You must also be able to work and actively seeking work.

Hello,

Im currently on STD leave since Nov 2014 with my Employer from an chronic illness that im suffering from. In Dec 2014 my Employer let me go due to exhausating my FMLA and denial of my ADA, however still covered up to 6 months of STD. So Im wondering after 6 months I recover can I apply for unemployment until I find another job?
Please advise.

You can apply, but you may not qualify for much in the way of benefit. There is a look-back window of employment and wages when you apply for UI benefits. If you had $0 income in that time period, you will have a very small amount of benefit, if any. Disability income is not counted.

look you guys do not need to switch from one to next while she's receiving unemployment, she need to go and fill out an application for disability because it can take 6 month to a year before she receive answer. however been a temporary disability is possible that the state pick up that tab. The SSDI is Social Security Disability Insurance meaning when we work we pay FICA right so the more we work the more we pay and the time come that we can't work no more does when we get some SS even though you were middle class before you become sick with Spinal Stenosis after living on disability u live below poverty. all u have to do as apply for disability and leave the unemployment the way it's. I hope it help u not breaking any laws by doing this good luck

There may be some accurate parts to your post, but unemployment insurance benefits and disability do not mix. A disabled person may not have a job, but they cannot be "unemployed" and receive unemployment insurance benefits. Similarly, a person who is receiving unemployment benefits MUST be able to work AND actively seeking work. By definition a disabled person cannot meet both of those tests.

Your grammar is a bit hard to follow, but this is not entirely true. Just because a person pays FICA contributions does not mean he/she will automatically get a disability benefit simply because "we can't work no more."

While it does take a minimum of five full months of disability before a person could even begin to collect a SS Disability benefit, the primary qualifying test is that a person MUST BE "unable to perform any substantial gainful activity" which means any type of work in the American economy that a person could not do with his/her impairment and earn about $1100 per month.

But the most recent post is not even about that topic. It is about collecting unemployment benefits after a period of disability. Although that might be possible, as I stated above, the amount of benefit a person might qualify for will be severely limited by the fact that he/she did not have much income during the period of time that is used to measure a person's income in order to determine the benefit amount.

I had surgery and was out of work for 3 months I just got cleared to go back to work brought my slip to my boss and she has the next two schedules already done up. She says she has no hours for me for this week (even though I'm a full time employee and we have part timers who have like 30-35 hrs) coming up and not sure about the following. So my disability ends on the 7th now would I be able to get unemployment until she puts me back on the schedule?

You may have rights to your position under the FMLA. Contact an employment law attorney for a consultation.

Unemployment has a 7 day waiting period before benefits begin.

I have been on temp disability in nj since march 1 2017 I was going to return to work July 31 2017 I had an operation on my lung then went on cancer treatment. My boss told me today that they are letting me go. I kept up with them and told them how I was and they always seemed concerned. My Dr didn't want me to return to work until Sept but I wanted to get back as soon as possible. Do I wait till my temp disability ends then can I collect unempoyment. This is such a shock and I don't know where to turn. I had actually stopped at work to see everyone and had no hint that this was going to happen.
